1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User" or "you") and Solid Software B.V., a company registered in the Netherlands (KvK number: 94194432) ("Company," "we," "us," or "our"), governing your use of the PokerBrain mobile application (the "App").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

2.1 App Overview

PokerBrain is a mobile poker training application designed to teach users poker strategy, range-based thinking, and mathematical concepts through interactive gameplay and educational content.

2.2 Core Features

• Range-Based Learning: Training in hand range analysis and strategic thinking.
• Interactive Gameplay: Four distinct training game types (Hand Strength, Equity Estimation, Play Poker, Range Estimation).
• Educational Content: Poker mathematics, pot odds calculations, and strategic analysis tools.
• Progress Tracking: Performance monitoring and skill development analytics.

2.3 Virtual Currency

The App uses virtual "play chips" for training purposes only. These chips:

• Have no real-world monetary value.
• Cannot be exchanged for real money, goods, or services.

3. Eligibility and Account Registration

3.1 Age Requirements

• You must be at least 13 years old to use the App.
• Users under 18 years old may require parental consent depending on jurisdiction.
• The App is not intended for children under 13.

3.2 Account Creation

• You may create an account using email/password, Google Sign-In, or Apple Sign-In.
• You are responsible for keeping your login credentials secure.
• You must provide accurate and complete information.
• Only one account per person is allowed.

3.3 Account Security

• You are responsible for all activity on your account.
• Notify us immediately of unauthorized use.
• We are not liable for losses caused by your failure to secure your account.

4. Subscription Services and Payments

4.1 Subscription Plans

Premium features are offered through subscriptions:

• Monthly subscription (auto-renewal).
• Annual subscription (auto-renewal).
• Features and prices are displayed in the App at purchase.

4.2 Payment Processing

• All payments are processed through Apple App Store or Google Play Store.
• Payment terms follow the respective platform's terms.
• Prices include applicable taxes and are displayed in your local currency.

4.3 Automatic Renewal

• Subscriptions renew automatically unless cancelled at least 24 hours before the period ends.
• Your account will be charged for renewal within 24 hours of expiry.
• You can manage or cancel subscriptions via your device settings.

4.4 EU Consumer Withdrawal Rights

If you are an EU consumer, you have the right to withdraw from your purchase within 14 days without giving any reason (EU Directive 2011/83/EU).

For digital content, you may lose this right if you expressly consent to immediate performance and acknowledge that you lose the withdrawal right.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use the App solely for:

• Personal, non-commercial educational purposes.
• Learning poker strategy and mathematical concepts.
• Training and skill development in poker-related topics.

5.2 Prohibited Activities

You agree NOT to:

• Use the App for illegal purposes.
• Attempt to gain unauthorized access to accounts or systems.
• Reverse engineer, decompile, or disassemble the App.
• Create derivative works based on the App.
• Use bots or automated systems to interact with the App.
• Share account credentials.
• Interfere with the App's operation.
• Use the App for real money gambling.

6. Intellectual Property Rights

All content in the App (software code, algorithms, UI design, graphics, text, trademarks, etc.) is owned by us and protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

7. Privacy and Data Protection

Your privacy is important to us. Use of the App is subject to our Privacy Policy, which is incorporated by reference into these Terms.

8. Disclaimers and Warranties

The App is provided "as is" and "as available" without warranties of any kind, including merchantability, fitness for purpose, or non-infringement.

The App is for educational and training purposes only. We do not guarantee improvement in real poker performance.

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages.
• We are not liable for loss of profits, data, goodwill, service interruptions, or inability to use the App.
• Our total liability is limited to the greater of:

Exceptions (this limitation does not apply to):

• Personal injury or death caused by our negligence.
• Fraud or fraudulent misrepresentation.
• GDPR data protection violations.
• Any liability that cannot be limited under Dutch or EU law.

For EU consumers, your statutory rights remain unaffected.

10. Termination

10.1 Termination by You

You may terminate your account by:

• Deleting the App from your device.
• Contacting us to request account deletion.
• Cancelling subscriptions via your device settings.

10.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if you:

• Violate these Terms.
• Engage in fraudulent or illegal activity.
• Remain inactive for an extended period.
• Pose security or technical risks.

12. Governing Law and Jurisdiction

These Terms are governed by Dutch law. Disputes will be submitted to the competent courts of Amsterdam, the Netherlands.

If you are a consumer residing in the EU, you may also bring legal proceedings in your country of residence under applicable consumer protection law.
